Article 1. Definitions and Applicability
- Seller: Vintage by Lexie, established in Blaricum and registered with the Dutch Chamber of Commerce.
- Buyer: The natural person (consumer) or legal entity (business) entering into an agreement with the Seller.
- These terms and conditions apply to every offer, order, and agreement concluded via the online shop of the Seller.
Article 2. The Offer and Character of Vintage Products
- The online shop exclusively sells unique vintage, antique, and second-hand interior goods.
- The Buyer declares to be aware that these products contain signs of use, age-related wear, imperfections, patina, or previous repairs. These are inherent to the historical character of the product and can never be classified as defects.
- All images, dimensions, and specifications in the online shop are represented as accurately as possible. Colors may vary slightly on digital screens. Minor deviations in sizes or colors do not entitle the Buyer to compensation or dissolution of the agreement.
Article 3. Conclusion of the Agreement
- The agreement is concluded at the moment the Buyer has fully completed the order process in the online shop and the payment has been processed.
- The Seller reserves the right to refuse or cancel orders without stating reasons (for example, if a unique item is sold twice due to a stock system error). In such cases, the paid amount will be refunded immediately.
Article 4. Prices, Margin Scheme, and Payments
- All stated prices are in Euros (€) and include VAT, but exclude shipping or transport costs.
- Please note: The statutory VAT margin scheme (margeregeling) applies to most vintage goods. This means that no VAT will be specified on the invoice.
- Orders must be paid in full using the provided online payment methods in the webshop before the Seller proceeds with shipment.
Article 5. Shipping, Delivery, and Transport Risk
- All vintage and interior products are carefully inspected and packed prior to shipment.
- Delivery Risk: In accordance with EU consumer law, the risk of loss or damage during transit remains with the Seller until the package is physically delivered to the Buyer or a designated third party (such as a neighbor).
- Collection by Buyer: If the Buyer chooses to arrange their own courier or transport service for pickup, the risk transfers to the Buyer the moment the item is handed over to that courier.
- Mandatory Damage Reporting: Upon receiving the package, the Buyer must immediately inspect the items. In the rare event that an item arrives damaged due to transport, this must be reported to the Seller via email (vintagebylexie@gmail.com) within 48 hours of delivery.
- Required Proof: To process a damage claim, the Buyer must provide clear photographic evidence within this 48-hour window. This must include: photos of the damaged item, photos of the original packaging materials, and photos of the shipping label on the outside of the box. Failure to report damage or provide the requested photographic evidence within 48 hours will result in the expiration of any right to a refund or replacement.
- Incorrect Address: The Buyer is solely responsible for entering the correct delivery address. Any additional costs resulting from an incorrect address or failure to collect the parcel from a pickup point shall be borne entirely by the Buyer.
- International Shipments: For shipments sent outside the Netherlands, any import duties, customs fees, VAT, and other local government levies shall be borne entirely by the Buyer. The Buyer is responsible for handling any customs formalities.
Article 6. Right of Withdrawal (Return Conditions for Consumers)
- Consumers within the EU have a statutory right to withdraw from their online purchase within 14 days of receiving the product, without giving any reason.
- Notification: The Buyer must notify the Seller of their intent to return the item in writing via email within this 14-day window.
- Return Shipping Costs: All direct costs for the return shipment shall be borne entirely by the Buyer. This explicitly applies to shipments that cannot be returned by regular post due to their size or heavy weight (such as furniture, large mirrors, or fragile lamps).
- Risk of Return Shipment: The Buyer bears the full risk of the return shipment. Damage, breakage, or loss during return transit is at the Buyer’s risk. The Seller strongly advises the Buyer to opt for an insured and registered shipping method with track & trace.
- Condition of the Product and Depreciation: As these are unique vintage or second-hand products, all items are photographically documented prior to shipment. The Buyer may only unpack or inspect the product to the extent necessary to assess its nature and characteristics. If the product is returned damaged, incomplete, modified, or with additional signs of use, the Buyer is liable for the depreciation. This depreciation may amount to up to 100% of the purchase price and will be deducted from the refund.
Article 7. Complaints and Inspection Obligation
- The Buyer is obliged to thoroughly inspect the delivered product immediately upon receipt (within 24 hours) for any defects or deviations that fall outside the normal vintage character.
- Any complaints must be reported in writing via vintagebylexie@gmail.com within 48 hours of receipt, accompanied by clear photographs of both the product and the packaging. After this period, it is assumed that the product was received in good condition.
Article 8. Warranty and Liability
- Because the items are second-hand, antique, and vintage goods, the Seller provides no commercial or manufacturer's warranty regarding the future lifespan, functionality, safety, or mechanical parts of the delivered items.
- The Seller is never liable for indirect damage, consequential damage, lost profits, or damage caused by the (incorrect) use or tipping over of the delivered vintage items.
- The total liability of the Seller due to an attributable failure is at all times limited to a maximum compensation of the invoice amount of the specific product.
Article 9. Website Use and Intellectual Property
- All texts, product descriptions, logos, and photographic materials in the online shop are the property of the Seller and are protected by intellectual property rights. It is not permitted to copy or use any visual material or text for commercial purposes without prior written permission.
- The Seller is not liable for damage resulting from any temporary unavailability or technical malfunctions of the online shop.
Article 10. Applicable Law and Disputes
- All legal relationships to which the Seller is a party are governed exclusively by Dutch law, even if an obligation is fulfilled wholly or partially abroad.
- Disputes will, in the first instance, be submitted to the competent court in the district where the Seller is established, unless mandatory statutory law dictates otherwise.
In the event of a discrepancy or dispute concerning the interpretation of these terms, the original Dutch text shall prevail.
